Our Commitment to Privacy
The SafeSpot Counseling & Play Therapy, PLLC is committed to protecting the privacy of your protected health information (“PHI”). We are required by law to maintain the confidentiality of PHI, provide this notice describing our legal duties and privacy practices, and follow the terms of this notice in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and applicable Texas state laws.
What Is Protected Health Information (PHI)?
Protected Health Information includes information that identifies a client and relates to mental health treatment, payment for services, or health care operations. PHI may be written, spoken, or stored electronically.
How We May Use and Disclose PHI
Treatment​
To provide, coordinate, or manage mental health care services. This may include consultation with other licensed professionals involved in treatment, supervision, or continuity of care, as permitted by law.

Payment
To obtain payment for services provided, including billing, insurance claims, eligibility verification, and collection activities.

Health Care Operations
For practice operations such as quality assurance, record management, supervision, training, licensing, and legal or ethical compliance.

As Required by Law (Texas & Federal)
PHI may be disclosed when required by law, including but not limited to:

Suspected abuse or neglect of a child, elderly person, or dependent adult

Court orders, subpoenas, or lawful requests

Public health or law enforcement requirements

To Prevent Serious Harm
PHI may be disclosed when necessary to protect the health or safety of the client or others, consistent with Texas law and professional ethical standards.
Uses and Disclosures Requiring Authorization
Any use or disclosure of PHI not described above requires the client’s or legal representative’s written authorization. Authorization may be revoked in writing at any time, except to the extent that action has already been taken.
Minors and Parental Rights (Texas Law)
In Texas, parents or legal guardians generally have the right to access their minor child’s mental health records. However, access may be limited if disclosure could reasonably be expected to cause harm to the client or interfere with the therapeutic relationship, as allowed by Texas law.

Therapists may provide parents with general information regarding treatment progress while maintaining appropriate clinical confidentiality.
Client Rights
Clients (or their legal representatives) have the right to:

Request amendments to their PHI

Request restrictions on certain uses or disclosures

Request confidential communications

Receive an accounting of disclosures, as required by law

Obtain a paper copy of this notice at any time

Filing a complaint will not affect your care or result in retaliation.
Changes to This Notice
We reserve the right to revise this Notice of Privacy Practices. Any changes will apply to all PHI maintained and will be posted on our website and available upon request.
